Guardian Home Contract
Guardian Home Contract
By and between the Breeder and the Guardian.
The Breeder
Breeder Name Deanna Fritsch
Street Address 14860 George Ice Rd
City, State, and ZIP Glenford Ohio 43739
- (Female guardians) As incentive for you to keep the dog healthy and help produce larger litters, we will pay you $300 for each litter of 2 or more puppies.
- Guardian Agreement We created a Guardian-Home program to grow our breeding program while still providing each of our breeding dogs with a loving environment in a forever family. By joining our program, you desire to and will act as a guardian for a dog that is either a female potential breeder or proven breeder or a male potential breeder or proven breeder, subject to the terms of this Agreement.Mi-de-doodles remains the owner of the puppy until completion of contract at which time we ask guardian to spay or neuter dog and then we will turn permanent ownership over to guardian home.
Benefits of the guardian home program to the guardian family:
1.The dog you are being a guardian to will be released to you with no charge once we retire the dog from the breeding program. We intend to breed females 2-4 times prior to retiring dog from program.
2. Mi-de doodles will reimburse you up to $100 for annual vet checkup as long as dog is in our program. Do not give any vaccines (except for rabies) without discussing with us. We firmly believe animals are over vaccinated thus possibly shortening their life span. You must email vet records to midedoodles@gmail.com
Initial obligation of guardian family
1.To be considered for the guardian home program we require that you live within one hour of zip code 43739
2.Own your own home and have physical fencing to provide a safe and secure environment for the dog. This also protects the dog from any unplanned/unwanted pregnancies, and you also agree to never leave the dog off leash in an unsecured area. No dog parks allowed EVER!
3.Have reliable transportation and willingness to bring the dog to us when needed throughout the year for breeding purposes i.e testing, breeding, whelping etc. Owner/breeder may choose to come and pick up the dog for breeding purposes but this is not to be expected.
- All breeding expenses to be covered by owner/breeder. All other veterinary care including E.R visits to be covered by guardian home-with the exception of annual checkup provided by breeder/owner. 4.Maintain open lines of communication with us concerning any matter related to the dog
5.Keep the guardian dog on food approved by owner/breeder. There are ingredients in some foods that can affect fertility. We have found that if you don't offer a lot of treats, your dog will not become a picky eater and thus need to change foods.
6 Understand that the breeder may need to make decisions about the dog and you will have to respect those decisions. Examples may include but are not limited to keeping the female longer for breeding or raising her pups, additional vet care etc. We also may decide not to breed your female for a variety of reasons e.g failure of health testing, temperament, size etc. If we decide to eliminate her from our program you will be asked to have her spayed and we will turn over ownership. All decisions will always be for the betterment of the dog
- Notify breeder/owner at first sign of female dog coming in to heat. We must track this so we can plan breedings. We do not breed on first heat and possibly not until the 3rd but we have to track ALL heat cycles for planning purposes.
Ownership
Ownership and all rights and title and interest in the dog shall remain with the owner/breeder. If the dog is a female any puppies born to the dog shall be the sole property of the owner/breeder. The guardian family shall have no ownership interest of possession rights to any such puppy. If the dog is a male all semen shall be property of the owner/breeder and the guardian family shall have no ownership interest of possession rights to any use of the semen. The dog shall be used as breeding stock exclusively by the breeder and under no circumstances shall be bred to any dog other than as directed by the breeder. After the dog ceases to be a a part of our breeding program, breeder/owner shall, by written evidence of transfer assign and transfer ownership of the dog to the guardian family after receiving proof that dog has been spayed/neutered.
Possession
Upon the execution of this agreement breeder/owner shall transfer possession of the dog to the guardian family The guardian family shall retain possession of the dog during this agreement subject to its obligations to return possession of the dog for breeding purposes and shall provide physical care to and supervision of the dog subject to the terms and conditions of this agreement
Owner’s possession for breeding
Male-Primarily used to breed with owner’s females but may also be used 6+ times year for outside breeding. You will be paid $200 for each successful breeding. A successful breeding is one that results in at least 2 puppies. When breedings are scheduled we will need the male for approx. 3-4 days. There will also be a couple of appointments for hip, elbow and heart evaluations and sperm collection to make sure he is good for breeding. Males may be bred as early as 1 year but we will not breed males beyond 6 years so as to end the guardianship.
Female: Owner requires access to female breeding dog for reasons including, but not limited to:
1.Veterinary appointments for general purposes and/or to monitor pregnancy-possibly 2 visits
2.Breeding-First sign of going into heat (blood) until a successful tie. Dog may have vet appointments for progesterone testing every few days. We may need dog for 3-7 days until bred successfully. Dog will then be returned to guardian. Other vet visits during this time may be for ultrasound, xrays etc.
3.Whelping- Dog is to be brought to and will remain with owner/breeder from 7 days prior to the dogs due date and up until the puppies are weaned at approximately 6 to 8 weeks. During this time visitation by guardian family will be at the sole discretion of the owner/breeder. We limit or deny visitations depending on how the mother is reacting. The earliest we would consider a visit is when puppies are 3-4 weeks old and the weaning process has started.
4.The guardian family shall not transfer possession of the dog to any person without the prior written consent of the owner. In most instances, if you are no longer willing to honor this contract, dog will be returned to owner/breeder Mi-de-doodles.
5.Breeder/owner has the right to visit the residence of the guardian family at least once per calendar year to discuss with the guardian family any issues concerning the care and supervision of the dog. Coming to see the dog also helps them stay familiar with us which is beneficial for breeding.
6.Females will be bred no more than 4 times. Actual number of litters will depend on the health of the mother, temperament of puppies and demand for breed.
7.If the breeder finds it difficult to reach the guardian family, is met with roadblocks or cantankerous communication in any form, comments, phone calls, text messages etc. that make this working relationship hostile and/or if the guardian family refuses to do anything breeder asks as set forth in this document, the dog will be removed from the guardian home.
Guardian family obligations
1.Raise the dog as an indoor dog never to dwell outside except for short periods of time during the day.
2.When left at home safely contain the dog indoors. Although a crate is preferred keeping dog in a safe area where it can’t accidentally ingest anything when owner is gone is acceptable as well.
3.Comply with owners nutritional and dietary guidelines and pay all cost and expenses associated with feeding the dog. We also ask that you keep dog on Nuvet vitamins. This is a minimal expense of approx $20 per month. Anything require from breeder that is for breeding purposes will be paid for by breeder. This may include folic acid, fertility support etc
4.Provide the dog with regular exercise and socialization. (people, locations and only spayed or neutered dogs)
- Provide us with the name of the vet that will be seeing your dog.
6.Provide pictures and updates when requested by breeder. As dog is getting close to breeding age, we will need some very good pictures of a well groomed dog sitting facing forward. If you are unable to get quality pictures please contact owner and we will take some. We need the dog to be groomed with a doodle teddy bear face. No shaved muzzles. Coat should be slightly long not shaved. Ears need to be cut fairly short with hair not hanging well below ear leather. Once we have desired pictures, you can groom the dog any way you like.
7.Schedule and pay for all veterinary appointments other than those associated with breeding and one annual checkup (which will be covered by the owner) and provide routine medical care appropriate for the breeding dog
8.DOG TRAINING is critical. We ask that your puppy earns a Canine Good Citizen award. This is a 10 step exam that any well trained puppy can pass. Please google what is required. You can either attend training or teach your dog yourself but this CGC should be earned by the time dog is a year old.
- 9.Notify the owner of any planned vacations and change of address phone or e-mail. We ask that if you are leaving dog when traveling that you leave it with a friend, neighbor or pet sitter. Dogs can pick up things in a kennel and therefore that is not permitted. Owner will need the name and phone number of anyone who will be caring for the dog. This is EXTREMELY important for breeding males as they may be needed for breeding to a female outside of owner's program.
Termination of agreement
This agreement shall terminate upon the occurrence of any of the following
1.Immediately upon the transfer of ownership of the dog to the guardian family
2.Immediately upon owners determination that the guardian family is non-compliant with the terms of this agreement and such noncompliance poses significant risk to the health, welfare and safety of the dog at which time possession of the dog returns to the owner
3.Immediately upon the death of the dog from natural or accidental causes
4.Immediately upon the guardian families permanent return of the dog to the owner for any reason
indemnity the guardian family agrees to indemnify and hold the owner harmless from and against all claims, liabilities, losses, cost, damages and expenses by reason of any damaged property or injury or death to individuals allegedly caused by the dog while in possession of the guardian family.
Please keep in mind these requirements are in place as we expect you to do your part in exchange for a dog at no cost to you. The value of the dog your are getting is $3500 and up. We have paid as much as $10000 for our males so this is a very serious part of our business.
IN WITNESS WHEREOF, the parties hereto have executed this Guardian Home Contract as of the day and year first above written.
